(Washington, D.C., February 12, 2014). Today, after the news that Senator Rand Paul finally filed his class action lawsuit over NSA telephonic metadata surveillance, Larry Klayman, the founder of Judicial Watch and now Freedom Watch, and a former U.S. Justice Department prosecutor had this to say:
“Having already preliminarily enjoined President Obama, Attorney General Eric Holder, NSA Director Keith Alexander and the NSA itself from illegally accessing the telephonic metadata of nearly the entire U.S. citizenry (see Court Order of December 16, 2013 in Klayman v. Obama, 13-cv-851), with the Honorable Richard J. Leon ruling that the illegal acts are “almost Orwellian” and a violation of the Fourth Amendment, Senator Paul finally entered the fray. We are pleased to have his support and the support of the other Plaintiff Freedom Works (not to be confused with Freedom Watch, of which I am the Chairman and General Counsel).”
“Senator Paul claims in a press release that his case will go to the Supreme Court. Indeed, the case which I filed is already before the Supreme Court, my having filed a Petition for a Writ of Certiorari Before Judgment on February 3, 2014. The other plaintiffs and I moved quickly once we received the favorable ruling by Judge Leon to have the Supreme Court resolve the split among different courts on the constitutionality of NSA’s surveillance. The Supreme Court will now decide whether to take up the matter by bypassing intermediate appellate review by the D.C. Circuit.”
Klayman added: “Imitation is the sincerest form of flattery. We are pleased that Senator Paul has finally taken up the fight and I trust that we can work together to protect the constitutional rights of all Americans.”
